Terms of Service

By accessing the MOE Maintenance website, submitting a request for a quote, or hiring our services, you agree to be bound by these Terms of Service. These terms apply to all visitors, users, and clients. If you disagree with any part of these terms, you may not access our services. We reserve the right to update or modify these terms at any time without prior notice, and your continued use of our services constitutes acceptance of those changes.

When you submit a form or request a quote via our website, you warrant that the information provided (including property size, address, and contact details) is accurate, current, and complete. Quotes generated online or over the phone based on user-provided data are estimates only and are not binding contracts. MOE Maintenance reserves the right to adjust pricing or refuse service if the actual property conditions, scope of work, or measurements differ from the information submitted through our forms.

All initial estimates are subject to a physical site inspection. Final pricing may vary due to factors such as landscape complexity, excessive overgrowth (for lawn care), ice accumulation (for snow removal), or other unforeseen conditions. A binding agreement is only formed once a final quote is accepted by the Client and confirmed by MOE Maintenance. Quotes are valid for 30 days unless otherwise stated.

Due to the nature of our business, all service schedules are contingent upon weather conditions. For snow removal, dispatch times depend on storm severity and accumulation rates. For lawn maintenance, rain or drought may delay scheduled visits. While we strive to adhere to a consistent schedule, MOE Maintenance shall not be held liable for delays caused by "Acts of God," extreme weather events, or unsafe working conditions.

Payment is due upon completion of service or as per the terms of your specific seasonal contract. We accept major credit cards and bank transfers. Invoices remaining unpaid after the due date may be subject to a late fee of 1.5% per month or the maximum permitted by law. In the event of non-payment, we reserve the right to suspend all future services immediately until the balance is resolved.

Clients must provide at least 24 hours' notice to cancel or reschedule a service. Failure to provide notice may result in a cancellation fee. It is the Client's responsibility to ensure our crews have clear and safe access to the property (e.g., unlocked gates, no aggressive pets in the yard). If we arrive and cannot perform the service due to restricted access, the full service fee will still be charged.

MOE Maintenance carries standard liability insurance. However, we are not responsible for damage to hidden items left in the grass (toys, hoses, wires) or buried under snow that were not clearly marked or disclosed. While we take extreme care, minor scratches to pavement caused by snowplow equipment are considered normal wear and tear of winter services and are not subject to liability. Any claims for damage must be reported within 24 hours of the service.

We reserve the right to refuse service to anyone for any reason at any time, including but not limited to safety concerns, harassment of our staff, or failure to pay. Similarly, clients may terminate their service agreement with written notice, subject to the specific cancellation terms outlined in their individual service contract.

These Terms shall be governed and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any dispute arising from these terms shall be resolved exclusively in the courts located within the service jurisdiction.
